Chapter 5 - The Siege of Family Court

At nine o'clock the following morning, the snow had stopped, leaving the city buried under a thick layer of blue-white ice.

Inside Courtroom 204 of the Cook County Family Courthouse, the heat was humming loudly through the floor vents.

Claire sat at the counsel table wearing a dark gray suit, her hair pulled back tightly. Beside her sat an aggressive family law attorney named David Ross, whom Mark had hired through the police union’s legal defense fund.

Across the aisle sat three prominent corporate defense attorneys representing the state child welfare agency and the executive estate of Dr. Arthur Pendelton.

At the center bench sat Judge Harrison—a strict, elderly magistrate known for following the letter of procedural law without exception.

"Your Honor," the lead state attorney argued, standing at his podium. "We are requesting an immediate emergency custody order transferring the minor child known as 'Benjamin Cole' into state protective custody. The child’s legal status is currently disputed, his home environment is subject to an active criminal investigation, and Dr. Claire Vance has a clear, inherent conflict of interest as both the intake physician and an interested party claiming maternal relation."

Judge Harrison looked over his spectacles down at Claire's table. "Mr. Ross? How does the defense respond?"

David Ross stood up, adjusting his buttoned jacket.

"Your Honor," Ross began in a strong, resonant voice. "We are not dealing with a simple custody dispute. We are dealing with a mother whose child was abducted five years ago under a criminal syndicate led by Dr. Arthur Pendelton—who was arrested three hours ago on federal human trafficking charges."

A murmur swept through the small gallery.

The state attorney scoffed. "Allegations, Your Honor! Unverified claims made during a midnight police raid!"

"They are not allegations, Your Honor," Ross countered calmly. He picked up a thick stack of certified documents from his table and stepped forward to hand them to the bailiff. "This is the preliminary DNA matching report executed at five o'clock this morning by the State Police Crime Laboratory."

Judge Harrison took the documents from the bailiff, opening the folder.

The courtroom fell into an agonizing, breathless silence.

Claire held her breath, her fingers clasped tightly together on the table, her heart pounding in her throat.

Judge Harrison read through the three-page document slowly. He reached the final page, stopped, and adjusted his glasses.

He raised his head, looking directly at Claire.

"The DNA match," Judge Harrison read aloud into the quiet courtroom, "confirms a 99.998 percent probability of maternal relation between Dr. Claire Vance and the minor child registered as Benjamin Cole."

Claire let out a shuddering, involuntary sob, covering her face with both hands.

"Furthermore," Judge Harrison continued, his voice heavy with quiet authority, "in light of the evidence submitted regarding the systematic forgery of municipal adoption records by Aegis Management, this court finds that the child's legal identity is hereby restored under his birth name: Owen Vance."

The state attorney took a step back, his jaw slightly open, unable to offer a counter-argument.

"Your Honor!" Ross added, striking while the iron was hot. "We move for immediate, full legal and physical custody to be granted to his mother, Dr. Claire Vance, with a permanent protective order issued against Diane Vance and all associated entities of Aegis Management."

Judge Harrison did not hesitate. He picked up his wooden gavel.

"Motion granted," Judge Harrison declared, bringing the gavel down with a sharp, echoing CRACK. "Owen Vance is returned to the custody of his mother, effective immediately. Court is adjourned."

Claire collapsed back into her chair, tears spilling freely down her face as David Ross clapped her on the shoulder with a triumph smile.

Out in the hallway, Chief Mark was waiting by the elevator, holding a paper bag containing a hot cup of coffee and a warm cherry Danish.

When Claire pushed the double doors open, Mark looked at her face and immediately cracked a rare, wide grin.

"We got him?" Mark asked.

"We got him," Claire wept, running forward and throwing her arms around the tall police chief's neck. "He's mine, Mark. Legally, completely mine."

Mark patted her back gently, his own eyes moist. "He was always yours, Claire. Now let's go take your boy home."
