Chapter 4 - The Legal Showdown

By two o'clock that afternoon, the conference room on the fourth floor of the Larimer County Justice Center was filled with tension. Judge Henderson presided over an emergency family law hearing convened on less than six hours' notice. Mara sat on one side of the table with her longtime family attorney, Sarah Vance, and Bree Donnelly. On the opposing side sat Tobin Rusk, his face pale and furious, flanked by a court-appointed duty lawyer and a deeply agitated Darlene.
"Mr. Rusk," Judge Henderson began, reviewing the affidavits on her desk with a stern expression. "Your ex-wife and the co-parent of your son have presented documentation indicating that your nine-year-old son, Ronan, is a matched bone marrow donor for your seventeen-year-old daughter, Keely. They have also presented audio recordings of a conversation you had in the hospital cafeteria yesterday."
Tobin’s attorney shifted uncomfortably. "Your Honor, my client was merely expressing concern for his son's physical safety during an invasive procedure—"
"Your client explicitly conditioned his consent for a life-saving transplant on the liquidation of fifty thousand dollars in real estate equity and the forgiveness of past-due child support," Judge Henderson interrupted coldly. "That is not parental concern. That is statutory extortion and a violation of fiduciary duty to both of his children."
Darlene stood up abruptly from the gallery bench. "Your Honor, Keely isn't even raised in our faith! Mara has kept those children apart—"
"Sit down, ma'am, or you will be removed by bailiffs," the judge ordered sharply. She turned back to Tobin. "Mr. Rusk, under Colorado Revised Statutes, when joint legal guardians disagree on an urgent medical decision involving a minor child where delay poses substantial risk to life, the court may grant sole medical decision-making authority to one parent."
"She can't just take my son into surgery!" Tobin protested, his voice cracking with desperation.
"She isn't taking him into surgery without medical ethics review," Judge Henderson said firmly. "An independent pediatric ethicist has already reviewed Ronan's assessment. The child expressed a clear, unprompted desire to assist his sister. Ms. Donnelly, as joint legal guardian, has executed full medical consent. I am issuing an immediate temporary order granting Ms. Donnelly exclusive medical authority regarding Ronan's participation in the bone marrow donation process."
Judge Henderson struck her gavel with a decisive crack. "Furthermore, Mr. Rusk, this court is initiating an immediate audit of your child support obligations. Any further attempt to interfere with or contact the medical teams treating Keely or Ronan will result in an immediate contempt charge and revocation of your visitation rights."

As the room cleared, Tobin stood frozen near his chair. When Mara walked past him toward the exit, he caught her arm gently, his face stripped of all bravado. "Mara... please. I didn't want it to get like this. I was just drowning in debt."
Mara looked down at his hand on her sleeve, then up into the gray eyes that had once brought her comfort after Hollis died. "You told me nine years ago that you show up, Tobin. But you only show up when there's something in it for you. Stay away from my daughter."
