Chapter 6 - The Arraignment

Courtroom 4A of the United States District Court in Seattle was silent, imposing, and cold. High oak panels lined the walls, and the seal of the United States hung prominently behind the elevated judicial bench.

I sat in the front row of the gallery alongside Thomas Vance and my CID liaison, Special Agent Miller.

At the defense table sat my parents and sister, accompanied by a court-appointed public defender named Marcus Vance (no relation to Thomas). They were wearing plain, dark civilian clothes provided by my aunt, looking small, withered, and thoroughly terrified.

The side door opened, and the bailiff announced, "All rise for the Honorable Judge Patricia Vance."

We stood as Judge Vance—a stern, sharp-featured woman in her late sixties with a reputation for zero tolerance regarding financial fraud—took her seat behind the bench.

"Please be seated," Judge Vance said, scanning the court docket. "We are here for the arraignment in United States v. Richard Carter, Eleanor Carter, and Madison Carter, Case Number 24-CR-892."

AUSA Sarah Jenkins stood up at the prosecution table. "Good morning, Your Honor. Sarah Jenkins representing the United States. Present in the gallery is the victim, Colonel Emily Carter, Commanding Officer of the 201st Strategic Intelligence Brigade."

Judge Vance looked over her glasses at me, bowing her head slightly in recognition of my service, before turning her sharp gaze toward the defense table.

"Mr. Vance," Judge Vance addressed the public defender. "Have your clients reviewed the indictment?"

"We have, Your Honor," the public defender answered, standing up nervously. "My clients wish to enter pleas of Not Guilty to all counts, and we request that bail be set at a reasonable personal recognizance level."

"Not guilty?" Judge Vance raised an eyebrow, picking up the preliminary evidence folder. "Mr. Vance, I am looking at certified electronic wire logs showing your clients spent ninety-nine thousand dollars on a luxury Hawaiian vacation using an active-duty military officer’s credit card, complete with recorded phone confessions provided by federal investigators. On what grounds are you pleading not guilty?"

Richard suddenly stood up from his chair, ignoring his attorney’s desperate attempts to pull him back down.

"Your Honor!" Richard shouted, his old arrogance flaring up one last time. "This is an internal family matter! Emily is my daughter! She’s doing this out of spite because of a personal disagreement! We had implied consent to use her credit line!"

Judge Vance slammed her wooden gavel down with a deafening CRACK.

"Sit down, Mr. Carter!" Judge Vance ordered, her voice echoing like thunder through the courtroom. "You do not speak in my courtroom without being recognized! And let me make one thing crystal clear to you and your wife right now: there is no such thing as 'implied consent' to use another person's Social Security number to run up a hundred thousand dollars in luxury debt across state lines!"

Richard shrank back into his seat, his face turning pale as his public defender glared at him in absolute frustration.

"Regarding bail," Judge Vance continued coldly. "Given the severity of the charges—including wire fraud, aggravated identity theft, and money laundering—and given the defendants' immediate flight risk as evidenced by their behavior in Hawaii, bail is set at $250,000 for Richard Carter, $250,000 for Eleanor Carter, and $100,000 for Madison Carter."

Eleanor let out a sharp gasp, her hand flying to her chest. "Two hundred and fifty thousand dollars?! Your Honor, we don't have that kind of money!"

"Then you will remain in federal custody at the Federal Detention Center in SeaTac pending trial," Judge Vance ruled coldly, slamming her gavel down a second time. "Court is adjourned."

Two uniformed federal marshals stepped out from the side doors, pulling heavy iron handcuffs from their belts.

As the marshals stepped up to the defense table, Madison began to scream, clinging frantically to her mother’s arm. "Mom! Mom, do something! I can't go to jail! I didn't do anything wrong! It was your idea!"

"Madison, shut up!" Eleanor shrieked as a female marshal pulled her hands behind her back, clicking the steel cuffs shut over her wrists.

Richard looked over his shoulder at me as the marshal cuffed him. His eyes were wide, filled with an agonizing mixture of rage, disbelief, and desperate, pathetic pleading.

"Emily!" Richard yelled as he was pushed toward the holding cell door. "Emily, tell them to stop! You're destroying your family! Emily!"

I stood in the center of the gallery, tall, silent, and immovable in my dress uniform. I watched them as the heavy metal doors opened, saw their terrified faces one last time, and watched them disappear into the grey shadows of federal custody.

I did not shed a single tear.
