Chapter 7 - The Courtroom Confrontation
Judge Patricia Vance presided over the hearing. She was a stern, perceptive judge known for her zero-tolerance policy regarding parental alienation tactics.
Marianne’s attorney took the stand first, attempting to present a picture of an overwhelmed, grieving single mother who had allowed a dangerous situation to occur.
“Your Honor,” Marianne’s attorney argued, “we do not dispute that Mrs. Nolan loves her children. But the facts remain: a five-year-old child was forced to navigate a sub-zero blizzard alone while the mother lay unconscious. Our client offers a secure, financial, and stable estate to prevent such terrifying risks from recurring.”
Judge Vance tilted her head. “Let us hear from the independent experts first.”
David called Dr. Marcus Thorne, a chief toxicologist from the Mayo Clinic in Rochester.
“Dr. Thorne,” David asked, “based on the blood gas analysis taken from Rebecca Nolan upon her arrival at the emergency room, what was her condition at 2:10 AM on the night of the incident?”
“Mrs. Nolan had a blood carboxyhemoglobin level of nearly twenty-eight percent,” Dr. Thorne testified clearly. “At that concentration, extreme confusion, loss of motor control, and rapid loss of consciousness are medically unavoidable. The human brain simply cannot function normally.”
“In your professional opinion, Dr. Thorne, how was she able to get three children out of their beds, bundle them into cold-weather gear, place two toddlers in a sled, call emergency services, and direct her daughter outside?”

“It is, frankly, a remarkable feat of maternal instinct and physiological willpower,” Dr. Thorne answered firmly. “Most individuals with those blood levels would have collapsed in bed. The fact that she successfully evacuated all three children before losing consciousness saved their lives. Had she delayed by even two minutes to try to carry them all herself, all four of them likely would have perished inside that hallway.”
A quiet murmur rippled through the gallery.
